Criminal Defense

Traffic Violations
As a result of pleading guilty or being found guilty of a traffic violation, the DMV will update your driving record with an assigned point. If you are unlucky enough to accumulate 4 points in one year, you are charged with being a negligent operator. The codes define which violations deserve a point and which moving violations amount to two points assigned. Moving violations include most violations except parking, on a bicycle, walking, vehicle registration and defective equipment issues. Be wary of the 2 point violations which come after convictions from DUI, reckless driving alcohol and non-alcohol related, hit and run driving, and driving on a suspended license.
Sex Crimes
Robbery
Mr. Lucas was charged with first-degree murder and robbery stemming from an argument at an area IHOP that escalated into a shooting, resulting in one fatality. Mr. Staten analyzed the surveillance cameras frame by frame, and pieced together what happened during the 10 minutes from the time the victim and friends entered the IHOP until the time shots were fired. The video clearly showed that Mr. Lucas acted as a peacemaker inside the restaurant, and was leaving in his car as the fight escalated into a shooting. The jury later returned verdicts of not guilty on all counts.
Misdemeanors
Misdemeanors are charges that are not or cannot be filed as felonies. If you hire counsel you do not have to take the time to appear in court. The maximum penalty is county jail time and in many cases you will be allowed to serve jail time in a work project program or community service. These are matters that can affect your employment or result in probation. There can also be an effect on your privilege to drive. Even misdemeanors should be taken seriously and you should always hire counsel or request a public defender to represent you in the process.
Drug Crimes
Outside of medical marijuana issues, drug cases come in two categories: possession for use and possession for sales/actual sales. The difference in the two categories may come down to the amount of drugs found and what other items are present to show the intended purpose of the drugs found. The penalties for sales cases are obviously higher and have more severe consequences than possession for personal use. In both cases, exercising your right to remain silent is important. In possession for use cases, many times a recovery program may be provided, allowing you to avoid a conviction. Since the common thread in all cases is who had possession and what they intended to do with it, exercise your right to remain silent even if confronted by law enforcement and questioned. Assault
Mr. Allen was accused of assault and battery on his girlfriend. He was facing 140 years in prison. KJS A Professional Law Corporation took the case to trial and the jury acquitted Mr. Allen of all counts. He walked out of jail a free man.
Murder
Mr. Alexander was charged with one count of murder and one count of attempted murder stemming from a shooting that occurred outside of an 18 and under club. Mr. Staten was able to resolve the case, and Mr. Alexander pled to being accessory after the fact, gang, and gun enhancement charges. Instead of facing a life behind bars, Mr. Alexander will only spend 8 years in prison.
Juvenile Crimes

Homicide
Second, SB 394 requires that children who have been sentenced to life without parole (LWOP) be given a parole hearing after 25 years of incarceration. Thus, a 15-year-old juvenile offender who was sentenced with LWOP will receive a parole hearing when he or she is 40 years old. This law brings California in line with recent Supreme Court decisions. For example, in 2005, the United States Supreme Court held that juveniles have lessened culpability than adults because of the “fundamental differences between juvenile and adult offenders” (Roper v. Simmons (2005) 543 U.S. 551). Then in 2010, it ruled that it is unconstitutional to sentence a youth who did not commit homicide to a sentence of life without the possibility of parole. The Court explained that the Eighth Amendment, which prohibits cruel and unusual punishment, “does not foreclose the possibility that persons convicted of non-homicide crimes committed before adulthood will remain behind bars for life. It does forbid States from making the judgment at the outset that those offenders never will be fit to reenter society” (Graham v. Florida (2010) 540 U.S. 48, 51-52). Again, because this new legislation will require new, necessary hearings, it also makes time provisions to allow the Parole Board to catch up, and sets deadlines for the newly required hearings.
